These Terms of Use ("Terms") govern your access to and use of goPodcasters (accessible at gopodcasters.com), operated by R&T Media Network ("we", "us", "our"). By creating an account or using the platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. About goPodcasters

• Circumvent or interfere with security features of the platform.
• Create multiple accounts to evade bans, suspensions, or restrictions.

5. User Content

5.1 Ownership

You retain ownership of the content you post on goPodcasters (posts, photos, messages, reviews, etc.). By posting content, you grant R&T Media Network a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your content in connection with operating and promoting the platform.

5.2 Responsibility

You are solely responsible for the content you post. We do not endorse or guarantee the accuracy, completeness, or reliability of any user-generated content.

5.3 Moderation

We reserve the right, but are not obligated, to monitor, edit, or remove any content that violates these Terms or that we deem inappropriate, at our sole discretion and without prior notice.

5.4 Reporting

If you encounter content that violates these Terms, please report it using the reporting tools available on the platform or by contacting us directly.

6. Intellectual Property

All content, design, graphics, logos, software, and other materials on goPodcasters that are not user-generated are the property of R&T Media Network or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without our prior written consent.

7. Direct Messages & Private Communications

Direct messages are intended to be private between the participating users. However, we may access message content when required by law, to investigate reported violations, or to ensure platform safety. We do not routinely monitor private messages.

8. Resources & External Links

goPodcasters may list third-party resources, tools, and services, and may contain links to external websites. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party sites or services. Accessing external links is at your own risk.

9. Account Suspension & Termination

• We may suspend or terminate your account, or restrict access to certain features, at any time and for any reason, including but not limited to violations of these Terms.
• We will make reasonable efforts to notify you of any suspension or termination, unless doing so would compromise platform security or violate legal obligations.
• You may delete your account at any time through your account settings or by contacting us.
• Upon termination, your right to use the platform ceases immediately. We may retain certain data as described in our Privacy Policy.

10. Disclaimers

goPodcasters is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The platform will be available uninterrupted, timely, or error-free.
• The information provided on the platform is accurate, reliable, or complete.
• Any defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by Dutch law, R&T Media Network and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the platform.
• Any conduct or content of any third party on the platform.
• Unauthorized access to or alteration of your transmissions or data.

Our total aggregate liability for any claims arising out of or related to these Terms or the platform shall not exceed the amount you have paid to us (if any) in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless R&T Media Network and its directors, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the platform, your content, or your violation of these Terms.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms or your use of goPodcasters shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands.

If you are a consumer residing in the European Union, you may also have the right to submit a dispute to the online dispute resolution platform provided by the European Commission at ec.europa.eu/consumers/odr.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

15. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by R&T Media Network.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and R&T Media Network regarding the use of goPodcasters, and supersede any prior agreements.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the platform or by email. Your continued use of goPodcasters after such changes constitutes acceptance of the updated Terms.
